Davenport Trial Set For February In Ohio Courtroom

CLEVELAND (KDKA) ― Pittsburgh Steelers' running back Najeh Davenport was in a Cleveland courtroom this morning over a domestic and child custody dispute with the mother of one of his children.

Davenport was attending a pre-trial conference where he learned he will be held for trial on February 28 on three charges -- domestic violence, unlawful restraint and endangering children.

The charges stem from an October 4 incident when he was attempting to pick up his 5-year-old son in Cleveland and he and the boy's mother, Anita Person, apparently got involved in some sort of scuffle.

KDKA's Paul Martino was in the courtroom.

He reports there were indications that a plea-bargain agreement may be under way so that Davenport may be able to plead to lesser charges and avoid a jury trial.

The most significant thing that came out of today's hearing is that Davenport, who has not been able to see his son since this incident, will now be allowed to see his son during supervised visits in Cleveland.

Plead after the season ends to put the 4 game suspension into 2008

maybe he didn't do it (I'm not saying he did or didn't) why should he plea if he didn't do what he was accused of?

Because if a Cleveland jury decides to stick it to a Steeler (there are enough witnesses to the altercation in the middle of the street other than the mother of Davenport's son to get the case to the jury) he could do time and with the suspension Goodell tacked on could miss 2008 and might not make it back into the league

Guilty plea + anger management course + settle civil suit by mom = plenty of $$$ for everyone in 2008 :thumbsup:

yeah, good point. If he is innocent i would hate to see that go on his record. lose/lose either way i guess

I just hope that other people in the same type of situation have the opportunity to push off their trials until it is best for them.

If not, this really torques me off. I don't care who he is, or who he plays for. A crime is a crime, and if he is charged, he needs to be given a trial just as if he was another citizen... cause that is truly who he is.

I doubt a Cleveland judge & DA are cutting Davenport any slack and a trial a little over 4 months after charges are brought is not an unusual delay.

Legitimate reasons for delaying the trial include: the prosecutor is probably up to his or her eyeballs in other cases that have been hanging around much longer; prosecutors do not like trying cases around the holidays (jurors or at least one holdout juror can get caught up in the holiday spirit and let the perp walk); while we are not talking about Ward & June Cleaver here it can be disruptive to the children to have Mom & Dad teeing up a domestic assault case during the holidays; and if a plea deal (+ resolving the all important civil suit to pay $$ to Mom) is in the works the case goes away without tying up court time.
