Default Judge Orders N.F.L. Concussion Case to Mediation

Let's make a deal?

The federal judge overseeing the case brought by thousands of former N.F.L. players who have accused the league of hiding the dangers of concussions ordered both sides to mediation Monday.

Mediation works. Maybe not in this case but its worth a shot.

At oral argument the judge was not wild about the NFL claim that the lawsuits were pre-empted by the collective bargaining agreement - smart move by the court to try and urge the parties to figure something out
