LoL that's just a flat out f##$ up. Won't be surprised if that guy ends up getting paid a little settlement to go away so the Austin Police can save face. It's one thing if the guy's eyes are bloodshot and glazed over, he can't stand on one leg, or walk in a straight line, and he smells like alcohol. When the guy blows a .000 though... These are the kinds of incidents police departments need to avoid to get out of the negative media. OWI arrests are very lengthy compared to other types of arrests. I've actually volunteered at the local police academy as a fake drunk driver for OWI arrest scenarios with police cadets. It's a lengthy process from field testing, to arrest, to going over the implied consent advisory, and finally to actual testing on an datamaster intoxilyzer machine if the person consents to any kind of testing. So basically these guys wasted their time arresting a guy who wasn't drunk, nor high. They wasted his time, and put him in jail for nothing, and wasted department time and the time and money of the taxpayers all on one big screw up. It doesn't make the department look good, and it got them into the negative media. I'm guessing those officers are going to get a talking to for that mistake.
