One of five Duquesne University basketball players shot on campus last year has sued the school, alleging it failed to provide adequate security at a dance.

The lawsuit, filed yesterday in Allegheny County Court, says those in positions of authority did not take action once they knew of potential criminal activity. A doorman let two armed men into the dance even after their friend asked if the men would be frisked, according to the lawsuit.

"Rather than alerting the campus police who were present inside the ballroom about (the frisking inquiry), or taking other similar reasonable steps, the doorman simply responded that they would not be frisked," and allowed the men to enter, the lawsuit states.

The player who filed suit, Stuard Baldonado, was one of five shot early Sept. 17 as they walked back from the dance. Also wounded were Aaron Jackson, Shawn James, Kojo Mensah and Sam Ashaolu, who was shot twice in the head.

Baldonado, a junior transfer from Miami-Dade Community College in Florida, was shot in the arm. The bullet, according to the lawsuit, hit an artery and then continued through his chest, missing his spine by a centimeter.

Two alleged gunmen are awaiting trial in the shootings.

Duquesne's Baldonado arrested again

Stuard Baldonado, a 6-foot-7 forward who already had been suspended from Duquesne University and its men's basketball team following his arrest on a drug conspiracy charge, was arrested again last night on a new drug charge.

City police said they spotted Baldonado smoking marijuana on a sidewalk near the school.

Officers from the city's Street Response Unit were driving along Tustin Street about 6 p.m. Wednesday, when they spotted Baldonado sitting on a plastic chair, smoking a blunt, city police Sgt. Eric Holmes said. A blunt is street slang for a cigar with the tobacco removed and replaced with marijuana.

Holmes said officers saw Baldonado throw the blunt away when he spotted them but that they could still smell marijuana.

Baldonado, a native of San Andres, Colombia, and a junior college transfer from Miami-Dade College in Florida, will be mailed a summons charging him with possession of a small amount of marijuana, Holmes said.

The sergeant said the same officers arrested Baldonado on Friday, accusing him with acting as a lookout for another man involved in a street drug deal.

Baldonado, who was one of five players shot last season following a dance on campus, first was arrested Friday while the Duquesne men's team was en route to Toronto for an exhibition tour. He did not accompany the team on the trip because of passport problems.

He missed all of last season recovering from a gunshot wound that nearly severed his spine.

1 drug charge against Duquesne player is dismissed

A drug conspiracy charge against a suspended Duquesne University basketball player was dismissed today.

A district judge ruled that Stuard Baldonado's presence near a suspected drug transaction was not enough to justify the charge. Judge Eugene Zielmanski made the ruling after hearing testimony from a police officer and arguments by defense attorney Owen Seman.

Det. Talib Ghafoor testified that Mr. Baldonado was acting suspiciously as police watched a suspected drug transaction in the Hill District Aug. 31.

But Mr. Baldonado had no drugs or cash when he was arrested. He did have a cell phone, and police believe he was acting as a lookout. A companion was arrested with drugs and cash.

But there was no testimony that Mr. Baldonado knew there was a drug transaction taking place.

Mr. Baldonado faces a separate hearing next month on a charge of marijuana possession stemming from a second arrest in September.

I'm sure they will also "drop" that charge. Kid is looking to throw a lawsuit at the university because he got shot (wonder why? it's becoming more clear) and he's getting off clean on drug charges. Unbelievable....WOW....lol.

Arrrrrrrrrgggggggghhhhhhh. The only thing that makes my blood boil more then idiot kids shooting each other is the scumbag lawyers chasing the ambulances looking to make a quick buck out other peoples suffering.
