Ray Rice OK'd for diversion program

Baltimore Ravens running back Ray Rice was accepted into a pretrial intervention program Tuesday that will result in the dismissal of his assault charge if he completes the program.

The pretrial intervention program is a diversion program that permits certain defendants (particularly first-time ones) to avoid formal prosecution.



Ray Rice was accepted into a pretrial intervention program that will result in the dismissal of his assault charge if he completes the program.

Rice will have to attend the program for the minimum of one year. If he successfully completes it, the third-degree charge of aggravated assault stemming from the incident on Feb. 15 involving Janay Palmer, who is now his wife, will be dismissed. The arrest would stay on his record but without the conviction.

"We're very happy with the result. We're glad that the court and the prosecutor's office agreed PTI was the appropriate disposition for the case," Rice's attorney, Michael Diamondstein, told ESPN's Adam Caplan when contacted about Tuesday's decision.

"This decision was arrived at after careful consideration of the information contained in Mr. Rice's application in light of all the facts gathered during the investigation," prosecutor Jim McClain said. "After considering all relevant information in light of applicable law it was determined that this was the appropriate disposition."

Rice was arrested and charged with simple assault-domestic violence on Feb. 15 after a physical altercation with his then-fiancée, Palmer, at the Revel Casino and Hotel in Atlantic City, New Jersey. Palmer also was charged in the incident.

Rice was indicted by a grand jury in late March for allegedly striking Palmer.

“First off, I would like to apologize,” Rice said, per the Twitter account, which added that he apologized to the Ravens organization, his fans, kids, and “everyone who was affected.”

Then, in what was perhaps the worst choice of words ever used by anyone on the planet, Rice said the following:

“I won’t call myself a failure. Failure is not getting knocked down. It’s not getting up.”

Considering there is video of him dragging the lifeless body of Janay Rice out of an elevator after she was knocked down, this was not the best life metaphor to use. But the fact that he believes the world is interested in his own personal recovery is a far more troubling and, frankly, disgusting sentiment.

The Ravens then tweeted a “no relationship is perfect” quote from Rice, as well as a quote from Rice saying he’s still the same guy he’s always been. Then, the Ravens tweeted a photograph of Rice and his wife, before saying that the running back was “getting very emotional when thanking his mom and father-in-law for being there to help him.”

Then, one more quote from Ray — “I’m working my way back up.” Good for you, champ.

And then the Ravens tweeted the worst possible thing the Ravens could have ever tweeted.

“Janay Rice says she deeply regrets the role that she played the night of the incident.”

Regardless of what did, or didn’t, happen during Ray Rice’s press-conference-that-wasn’t, the NFL eventually will take action against the Ravens running back, who has entered a diversion program to resolve charges of aggravated assault against his former fianceé, who’s now his wife.

Eventually, Rice will be summoned to the league office, for a meeting with Commissioner Roger Goodell. Unlike Rice’s press-conference-that-wasn’t, he’ll have to answer questions.

Frankly, Rice should have waited until the meeting with the Commissioner to say anything. Today’s press-conference-that-wasn’t doesn’t help Rice at all, either from the perspective of the league or in the eyes of the public. The timing of the event, on the cusp of the first unofficial bad news dump of summer, suggests that someone in Rice’s camp was determined to have a press-conference-that-wasn’t, and that someone else who didn’t want to proceed with it was able to steer the thing to a point where it would get the least possible attention.

Ravens' Ray Rice Suspended for 2 Games

In May, it was announced Rice would enter a program for first-time offenders that would clear his record of a criminal charge provided he met certain conditions, including participation in family counseling. Rice had been charged with third-degree aggravated assault following a Feb. 15 incident at a casino in Atlantic City. At the time, the former Janay Palmer was his fiancée. Both initially were charged with simple assault. The Atlantic County prosecutor's office later dropped the charge against her.

In March, Rice was indicted by a grand jury on the more serious charge of third-degree assault for allegedly knocking her unconscious. The charge carried a potential sentence of three to five years in prison upon conviction. After the grand jury indictment, Rice and Palmer were married.

At a press conference a few days after entering the program for first-time offenders, Rice pledged to again become a role model.

"Sometimes in life you will fail, but I won't call myself a failure," said Rice.

"One thing that I do know is that I am working every day to be a better father, a better husband, a better role model."

Rice, 27, awaits his seventh NFL season. He had four consecutive years with more than 1,000 yards rushing, but his production declined to 660 yards in 15 games in 2013. In February, Rice said he had second thoughts about playing through a hip injury sustained in the second game of last season. But he did not require surgery.

Free agent addition Justin Forsett received first-team snaps in the offseason ahead of Rice and Bernard Pierce, who's rebounding from shoulder surgery.

Players routinely received four-game suspensions for violating the league’s drug policy, whether they say they accidentally used banned substances or not. There has been no ruling yet for Jim Irsay, picked up with $29,000 on him and pills, and his own arrest for driving while intoxicated. Goodell says that he is waiting for the legal system to play out, except that he never did that with Roethlisberger. And as Jim Trotter pointed out the other day on ESPN.com, Jimmy Haslam, the Browns owner, doesn’t even get a public rebuke from the commissioner after having to write a $92 million check for defrauding his customers....

[Josh]Gordon was absolutely a threat to everybody else if he was driving while impaired. But the offenses that may get him sent away for a whole season mostly involved weed. If Gordon has been hurting anybody, he has been hurting himself.

But if Gordon were a Raven — and let’s face it, he’s a born Raven — John Harbaugh would probably think he was misunderstood, too. But then most Ravens who’ve gotten themselves into trouble have considered themselves profoundly misunderstood, all the way back to the now-sainted Ray Lewis....

For now it looks like Ray Rice got one game for slugging the woman who is now his wife, and one for dragging her out of the elevator. It’s nice to see her standing by her man, certainly, at least now that she can stand up.
