Hamilton Co. reimbursing Bengals for turf

Hamilton County taxpayers are getting ready to pay the Bengals $900,000 for the turf at Paul Brown Stadium.

The team installed the synthetic turf before the 2004 season after complaints about the grass the stadium had since its 2000 opening.

Hamilton County owns the stadium but leases it to the team. A clause in the lease calls for the government to pay for stadium upgrades - technology, turf and others - if they are done in other stadiums home to National Football League teams.

Specifically, the clause in the Paul Brown Stadium lease notes that Hamilton County must pay for new synthetic turf if any 14 other NFL teams have the turf or if seven of the other publicly funded stadiums have the turf.

"This is another example of how unfair this (lease) is to the taxpayers of Hamilton County," said Commissioner Phil Heimlich, who supported a county lawsuit against the team and league seeking to get hundreds of millions of dollars returned to the government.

"There's no limit to the number of gadgets they can buy and charge to the taxpayer."

He is particularly upset because, he said, the team issued an April 2004 press release that unfairly implied the team would pay for the turf and installation.

The Bengals counter that it did say it would pay for the turf, but the lease allows them to be reimbursed for that if other teams also got the turf.

County officials have admitted the lease allows the Bengals to charge the county for the field and other upgrades.

Earlier this year, the Bengals notified Hamilton County that the team believed the threshold had been reached and asked for the county to reimburse it for the synthetic turf and its heating system.

The seven NFL stadiums that are publicly funded and have the synthetic turf are used by the New York Jets and Giants, Seattle Seahawks, Atlanta Falcons, New Orleans Saints, St. Louis Rams, Buffalo Bills and Minnesota Vikings.

Hamilton County prosecutors have told county administrators that means the lease clause requiring Hamilton County to pay for the turf is now active.

Commissioners are expected to approve - by the end of the year - paying to the Bengals $296,535.32 - the first of three annual payments for the turf.

The Bengals could have required all of the money in one payment but are allowing the payments to be made interest-free, deputy county administrator Eric Stuckey said.

There have been more lawsuits and infighting over who should pay for what for that stadium than you can believe. It's generally linked to how well that team happens to be doing at any given moment.....imagine that???!!!

i wonder whats the bigger tax burden. the turf or the bengal players bogging down the criminal justice system? it isnt cheap to arrest, prosecute, and put these players through probation.

im suprised the team isnt trying to pass the bill for defense attorneys onto the people.

Just think if the court fines were equated based on the person's salary, they could pay for the turf in no time at all.
