I think you have a legitamate defense... being that the bengals hopes ended in a train wreck.

Actually crank the sound down on it ...muffle it...tinker with it...do what you gotta do...then take it with you and show how it isnt THAT loud....Then ask the judge if you can yell .....by showing that the whistle is equivelant to a good supportive cheer...he should just give you the obligatory warning

If you can't take it with you..ask for a continuance ...pending a sound test on the whiste to see if it exceeds the local ordinances...THEN tinker with it and crank it down.

( I'm so proud of myself for telling others how to beat the system)
