MIAMI -- Cleveland Browns wide receiver Donte Stallworth will be charged Wednesday with killing a pedestrian last month while driving drunk in Miami, according to people familiar with the case.

Two people said an arrest warrant charging Stallworth, 28, with DUI manslaughter will be filed Wednesday in the March 14 accident that killed 59-year-old Mario Reyes. The people requested anonymity because the charges haven't been announced.

The charge carries a possible 15-year prison sentence. Stallworth's blood-alcohol level after the crash was .12, well above Florida's legal limit of .08, according to results of a blood test. Stallworth also will be charged with DUI, according to the people informed about the case.

Stallworth, who is expected to surrender in court Thursday, released a statement last month saying he was "grief-stricken" over the accident.

A Miami Beach police report said that Reyes was not in a crosswalk on busy MacArthur Causeway when he was struck by the Bentley luxury car driven by Stallworth. The construction crane operator was trying to catch a bus home after finishing his shift around 7:15 a.m.

The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40-mph zone.

Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He previously played for the New England Patriots, Philadelphia Eagles and New Orleans Saints.

WTF ??? so he had the time and insight to try to warn the guy, but hitting the brakes and slowing down wasn't an option ???

Yeah, but the difference here is he's not denying he killed the guy, and there's really no other explanation for it or anyone else who could be blamed. If you run someone over while you're driving drunk, they don't look at much else; you're basically dogshit no matter what you do. The fact that it was a pedestrian he hit and not someone in another car works even more against him, since most places are very clear that if you hit a pedestrian, it's your fault unless he was, like, deliberately darting out into the middle of the street.

read somewhere else that minimum jail time in that state is 3.5 years.

So if he is convicted... he is gone.

With 3.5 years, he could conceivably be out in a couple years, though, which wouldn't rule out playing football again, although who would want him.

Although according to the Florida DUI laws (link) he can get up to 15 years for DUI manslaughter, plus six months for the DUI itself. Good thing he didn't flee the scene, or he could've gotten 30.

Didn't see any minimum sentence, but either way he's probably screwed.
