Burress Is Indicted on Weapons Charges

A grand jury has indicted Plaxico Burress, the former Giants receiver, on weapons charges in connection with a Nov. 28 episode in which he accidentally shot himself in the thigh in a Manhattan nightclub, the authorities announced on Monday. The grand jury decided not to indict a teammate, Antonio Pierce.

Mr. Burress was indicted on two counts of criminal possession of a weapon in the second degree, and one count of reckless endangerment in the second degree.

“The case required a more protracted investigation than does a typical weapons possessions case, given the number of witnesses and the need to investigate events both before and after the shooting,” the Manhattan district attorney, Robert M. Morgenthau, said in a statement. “The case was treated like any similar case against any other defendant. Ultimately, the grand jury did what it thought was fair.”

Mr. Burress, 31, who caught the winning touchdown pass in the Giants’ 2008 Super Bowl victory against the New England Patriots, accidentally shot himself in the right thigh while enjoying an evening out at the Latin Quarter Nightclub in Manhattan last fall. The gun had been hidden in the elastic waistband of his sweatpants and accidentally discharged. The gun, which his lawyer said had been bought legally in Florida, was not licensed in New York State.

His teammate Mr. Pierce, a middle linebacker, was with him at the club and drove Mr. Burress to NewYork-Presbyterian Hospital/Weill Cornell Medical Center, where he was treated for a flesh wound. Mr. Pierce has admitted stowing the gun after the shooting in the glove compartment of his car.

Three days after the shooting, Mr. Burress turned himself in to the police. He pleaded not guilty and was released on $100,000 bail.

Benjamin Brafman, Mr. Burress’s laywer, accused Mr. Morgenthau’s office of a “lack of flexibility.” He had tried to negotiate a plea that would have required less prison time than the mandatory minimum sentence of three and a half years. He argued that Mr. Burress deserves leniency because he was not carrying the gun to commit a crime, was the only person injured, had bought the gun legally, and agreed to testify before the grand jury.

“For an isolated act of poor judgment in which nobody else was hurt, this man may be separated from his family for several years and will lose a brilliant career,” Mr. Brafman said in an interview before Monday’s grand jury decision was announced.

For Mr. Burress, the shooting culminated a series of odd career missteps. After signing a five-year, $35 million contract, he was suspended for 12 days for missing team meetings and fined by the National Football League for criticizing officials. The Giants released him in April.

What an idiot...you shot yourself in the leg with your own gun...you plead not guilty to the charge of carrying a concealed weapon on you.

I hope the asshat gets the mandatory three and a half years in jail.

Doesn't matter that no-one was injured. How about the fact that there could have been more serious injuries from just a ricochet? Face it Mr. Brafman your client was an idiot, proved himself even more an idiot, and now you won't be able to collect anymore monies from him once he winds up in jail - at least for another 3 years! And that's what you're truly upset about!
