It could be a Republican

Ted Kennedy's death leaves an open Senate seat in Massachusetts for the first time in 25 years. State law requires a special election for Kennedy's seat to be held within 160 days.

Back in 2004, when John Kerry, the other Senator from Massachusetts was running for President, the Massachusetts State Legislature passed a law that changed the procedure for filling a Senate seat that had become vacant. Hitherto the Governor would appoint a replacement to serve out the term of a recently departed Senator.

The only problem is that the Governor of Massachusetts at the time was none other than Mitt Romney, a Republican. So the Massachusetts State Legislature decreed, over the objections of Governor Romney, that a vacant Senate seat in Massachusetts would be filled by a special election. The matter became moot, for the time being, as John Kerry failed in his attempt to be President and remained a US Senator.

This time the Governor of Massachusetts is a Democrat, but because of the law change he cannot appoint a replacement for Ted Kennedy, presumably another Democrat. Instead Ted Kennedy's replacement, unless the law is changed back to the way it was, will be chosen by a vote of the people.

They were scrambling around recently trying to get this changed when they knew Ted's days were numbered...the Dems NEED that seat to ram the POS healthcare legislation through...Byrd is kind of in the same boat...those are votes 59 and 60.

Former Massachusetts GOP Gov. Mitt Romney will not seek the Senate seat vacated by Ted Kennedy’s death, a Romney spokesman said Thursday.

A republican could have a good chance at the seat if there is a vote. Even though Mass. is a pretty lib state, the news will get out that this one seat could be instumental in the passingt of the healthcare vote

Very good point...there are a VERY few key issues EVER that create party jumpers. The Iraq War (and Obama's ensuing election) are one. This could be another. The American people do NOT want anything even approaching socialized medicine. Never have, and never will...this is very much beginning to look like the shoals the Dems are going to deliberately ram and ultimately sink their ship against...
