Army Officer Won't Accept Obama As Chief

WASHINGTON - The Army may be forced to court-martial a lieutenant colonel who refused to deploy to Afghanistan because he considers orders from President Barack Obama to be illegal, military officials told NBC News on Tuesday.

Army doctor Lt. Col. Terry Lakin believes Obama does not meet the constitutional requirements to be president and commander-in-chief because Lakin believes the president was not born in the United States. A video with statements from Lakin on the subject was released by the right-wing American Patriot Foundation.

Lakin refused to report to Fort Campbell, Ky., for deployment to Afghanistan, but instead went to the Pentagon. There on Monday he was confronted by his brigade commander, Col. Gordon Roberts, and informed he could face court martial, and his Pentagon building pass and government laptop computer were seized.

Roberts is the commander of the medical brigade out of Walter Reed. He is the only active-duty Medal of Honor winner in the military. He received the honor for action in Vietnam.

According to Lakin, he was read the military equivalent of his Miranda rights. No charges have been filed, but military officials believe they could include "missing a movement" or failure to report for duty, and "conduct unbecoming an officer."

One military official complained that Lakin, whom the Army describes as a "birther" because he's challenging Obama's birthplace, is being so persistent in his protest that the Army may have no choice but to order a court martial.

The Constitution states that a person must be a "natural-born citizen" to be eligible for the presidency. Birthers have contended that Obama's birth certificate is a fake, and many of them say he was actually born in Kenya, his father's homeland. They challenged his citizenship in court, and the issue became a staple of radio talk shows and conservative blogs.

Obama was born in Hawaii, and Hawaii Health Director Dr. Chiyome Fukino issued statements last year and in October 2008 saying that she's seen vital records that prove Obama is a natural-born American citizen.


The state registrar of vital statistics also has verified that the Health Department holds Obama's original birth certificate, copies of which were released by the Obama presidential campaign in 2008.

But that hasn't stopped the birther movement.

Last summer, an Army Reserve major volunteered to serve in Afghanistan, then filed suit to keep from being deployed, arguing that Obama was not a natural-born citizen. But a federal judge rejected the case, saying it was moot because the Army had already said that under rules for reserve volunteers, he didn't have to go.

i applied to the air force academy to be a field surgeon. granted, i wanted the scholorship to pay for my expenses, but moreso than that, i liked the idea of military duty, and if a soldier was in trauma, i wanted my eyes to be the last eyes they would ever look into knowing i was going to do everything humanly possible to save their life.

that is who a military doctor should be dedicated to serve. not no freaking president, or party, or administration.

the air force acadamy turned me down and the govt wasted their time with this piece of shit army "doctor" who was appearantly expecting a free ride.

this reminds me of a conversation i once had with a friend, back in 93. we were in the Army guard at the time, and discussion came up about possible mobilization. this was all hypothetical. he couldnt stand clinton. he pondered that if clinton mobilized us, that he might not go. his point was he joined under bush I, and not clinton. that is where his loyalties lay, and he viewed clinton as an anathema. my argument, and i didnt like clinton either, was, you joined to serve the Country and the State, not the President. as long as its not illegal, you go.

this idiot is putting his politics before his service. as tony stated, hes a doc, probably incredibly needed over there, which makes it worse. you refuse to go, you get brung up on charges. id go with treason, in my opinion, but that isnt likely, and probably not prudent. strip him of his rank, and send his ass to the cleaners.

And now he has the balls to say he isn't going to honor his oath as a soldier or his obligation to the US ARMY as a doctor.

Perhaps he just needs to be dishonorably discharged (and then required to refund the US ARMY the cost of his medical education). We don't need soldiers or doctors like that...

He server in Vietnam and earned the medal of honor, I hightly doubt he is afraid to go to the Middle East. Besides, with his rank and tenure, I also highly doubt he would be in harms way.

No, I'd say he is sacrificing his career and all the benefits (retirement etc) for something he truly believes and wants it to be made "front page".

I wouldn't sacrifice all that he is prepared to give up but that's just me. No matter if they elected a monkey to the oval office.

Difficult to get my head around this one. I wonder what he would do if they showed him irrefutable proof.

Also, Bruce Lee was born in the US but to elect him president (if he would have lived long enough that is) would be ludicrous. He was born in San Fran and immediately went back to China, which is more than likely the same situation for Obama except that he went back to Kenya to learn the socialist idealogy.
